DTC Minutes of Car Parks Meeting 2nd December 2015

Minutes of the Car Parks Committee Meeting held on the 2nd December 2015 at 2.30pm the Council Office, Lady Street.

Present:Councillors: Mrs Margaret Rawle, Mrs Christine Dubery; Mr Gerry Lewis and Mr Nick Thwaites.

Apologies:Mr Steve Ford

Future Car Park Management Proposals - Councillor Karen Mills W.S.C. and Mr Chris Hall (W.S.C.)

Members were informed that W.S.C. is required to make significant saving (1.5 million over the next 5 years). The decisions made will have considerable impact throughout the District, however WSC have a legal duty to sign off a balanced budget.

According to Cllr. Mills and Mr Hall the decision to take the management of the car parks back in house in order to maximise every opportunity to ultimately increase income and reduce spending, was a relatively easy one. It will meet three important criteria; it will not impact on the public, employees or minority groups.

W.S.C. want to take back control of the entire asset group. To have one strategy for all the car parks in the District with regards charges, shopper permits and free parking etc.

The proposal will be to take the Dulverton car parks back in house as from 1st April 2016. Officers are aware that this will cause a breach of the Licence Agreement; however members will effectively be advised that the risk of legal action being taken against WSC is minimal.

Furthermore W.S.C. does not consider that this decision will impact on the public.

DTC members rejected the argument that there will be no impact on the public pointing out that increase parking charges would encourage the public to shop elsewhere and have a disastrous effect on the economic viability of the Town.

Furthermore it was pointed out that it would affect existing employees. DTC currently employs two Car Park Supervisors who work on a part time basis.

The Clerk was requested to forward copies of the contracts onto Mr Hall as WSC will be required to consider the TUPE process.

Ideally WSC would strive to obtain a negotiated solution to mutually terminate the contract as from 1st April 2016.

Issues for negotiation:

  • That DTC would propose the fees for year Commencing 1st April 2016, to be approved by WSC.
  • Permits issued by DTC up until 31st March 2016 will be honoured.
  • That DTC would retain the revenue from the permits sold up until 1st April 2016.
  • That a lump sum would be paid by WSC to DTC as compensation for the loss of revenue for the year 2016/17. The suggested amount being £2,500.
  • That WSC, prior to making major decisions concerning changes regarding the car parks, would consult with DTC.
    • Closing the car parks for any reason to paying customers would need the agreement of WSC, e.g. Farmers Market, Starlight, Sight and Hearing screening etc. Cllr. Mills was not prepared to give a guarantee but stated that it is unlikely that W.S.C. would refuse permission.
    • Disabled parking is not likely to be free.

It was agreed that:

  • A package of arrangements will need to be negotiated and agreed.

Annual Enforcement Summary:

Details were provided concerning enforcement figures as from 1st January 2015 to 30th September 2015. Members were informed that twenty – two enforcement notices have been issued during this period. An invoice for £1,109.90 is expected from S.C.C. concerning NSL costs.

Financial Statement:

Members were provided with a statement of accounts and details concerning the revenue received to date and the anticipated income and expenditure from December 2015 up until 1st April 2016.

Car Park Supervisor Contract & Wages:

The Clerk was requested to make the Car Park Supervisor’s aware of the W.S.C. proposal to take the car parks back ‘in house’ and explain the options opened to them. It was noted that revenue had increased slightly during the first two quarters of this financial year in comparison to last year.

Car Park Fees from 1st April 2016:

Having considered the current car park fees imposed by WSC throughout the District, it was

resolved to recommend the following charges are implemented with regards the car parks in Dulverton for the season commencing 1st April 2016 as follows:

Permits: Annual         - £90.00

             Six monthly - £50.00

             Exchange     - £5.00

Lion Car Park:     1 hour       50p

                            2 hours   1.50p

                             3 hours   2.00p

                            

Guildhall

                             2 hours   1.50p

                             3 hours 2.00p

                             Daily       4.50p

                             Weekly   25.00p

Exmoor House

                             2 hours    1.50p

                             3 hours    2.00p

                             Daily      4.50p

                             Weekly   25.00p

Permits holders are entitled to park in any of the car parks in Dulverton.

RESOLVED: To recommend that the fees above are submitted to W.S.C. Proposed by Mr Lewis, seconded by Mrs Rawle and carried.

Administrative Assistant Overtime Payment:

Members were requested to consider an overtime payment to the Administrative Assistant.

RESOLVED: To pay eight hours overtime to Mrs S. Gosling. Proposed by Mrs Rawle, seconded by Mrs Dubery and carried.

Somerset Sight Mobile Unit Parking Request:

RESOLVED: To recommend that Somerset Sight are given authority to park their mobile resource unit in Exmoor Car Park on the following dates:

     17th Feb 2016

     12th May 2016

     15th September 2016

     6th December 2016

Proposed by Mrs Dubery, seconded by Mrs Rawle and carried.

Matters to Report with permission of the Chairman:

Motor Cycle Signage: WSC was requested to erect signage indicating the new official parking facilities for motor bikes and bicycles at the entrance tp the Lion Car Park.
